People often confuse the Constitution with the Declaration of Independence. There is no mention in the Constitution of Life, Liberty and the Pursuit of Happiness. There are many who believe that the Pursuit of Happiness clause in the Declaration insures that they can do whatever they want. Not so. The Constitution is the supreme law of the United States and provides the framework for the United States Government.
The Preamble of the Constitution states:
We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defence, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America.
(BTW, I can still sing this Preamble - thanks SchoolHouse Rock!)
The Preamble does not confer any specific rights to citizens of the United States, but some judges have interpreted it to mean what the founding fathers intended for the country. Although not considered law, the preamble has been used to make case rulings.
My Party’s Take - The Preamble to the Constitution is a nice introduction, but does not confer any right or establish any law.
